Scopul acestuia este de a transparentiza rela\u021bia autorit\u0103\u021bilor publice cu mediul de afaceri, astfel \u00eenc\u00e2t s\u0103 existe egalitate \u00een sfera influen\u021bei procesului decizional.<\/p>\n<h2>Ce este lobby-ul?<\/h2>\n<p>Conform Proiectului de ordonan\u021b\u0103, activitatea de lobby reprezint\u0103 &#8222;orice contract organizat \u0219i structurat cu reprezentan\u021bi publici pentru exercitarea unei influen\u021be \u00een interesul unui client, \u00een sensul influen\u021b\u0103rii directe a activit\u0103\u021bii de legiferare \u0219i a proceselor decizionale la nivelul administra\u021biei publice locale \u0219i centrale.&#8221;<\/p>\n<p>Esen\u021ba activit\u0103\u021bii de lobby este a\u0219adar ac\u021biunea de <em>a influen\u021ba persoanele responsabile cu elaborarea politicilor publice, \u00een sensul lu\u0103rii unei anumite pozi\u021bii vis a vis de un anumit aspect din legisla\u021bie, \u00een scopul promov\u0103rii intereselor legitime ale unui grup<\/em>.<\/p>\n<p>Lobby-ul trebuie diferen\u021biat de advocacy, ce reprezint\u0103 orice ac\u021biune \u00eentreprins\u0103 <em>\u00een scopul influen\u021b\u0103rii politicilor publice prin diferite mecanisme (\u00eentruniri, conferin\u021be, scrisori deschise etc)<\/em>.<\/p>\n<p>\u00cen acest sens, nu consider\u0103m c\u0103 defini\u021bia activit\u0103\u021bii de lobby cuprins\u0103 \u00een Proiectul de lege surprinde esen\u021ba acesteia, vis a vis de activitatea de advocacy.<\/p>\n<h2>Cum se realizeaz\u0103 activitatea de lobby?<\/h2>\n<p>Pornind de la premisa ca orice activitate de lobby trebuie s\u0103 fie transparent\u0103 \u0219i s\u0103 respecte standarde \u00eenalte de integritate, este recomandat ca orice fel de reglementare s\u0103 pun\u0103 accentul pe implementarea principiilor unor bune practici \u00een materie.  Cele mai cunoscute sunt principiile activit\u0103\u021bii de lobby statuate de OECD.<sup>1<\/sup><\/p>\n<p>F\u0103r\u0103 a intra \u00een detalii cu privire la aceste principii care sunt publice, consider\u0103m c\u0103 cele 10 principii fundamentale cu privire la activitatea de lobby statuate de OECD ar trebui preluate fidel de legisla\u021bia na\u021bional\u0103 ce reglementeaz\u0103 activitatea de lobby.<\/p>\n<p>\u00cen acest sens, de\u0219i Proiectul de ordonan\u021b\u0103 a luat ca model legea austriac\u0103 privind transparen\u021ba \u00een domeniul lobby-ului \u0219i al reprezent\u0103rii intereselor, iar Austria este membr\u0103 a OECD, consider\u0103m c\u0103  Proiectul de ordonan\u021b\u0103 nu reflect\u0103 fidel urm\u0103toarele principii ale activit\u0103\u021bii de lobby:<\/p>\n<ul>\n<li>Asigurarea transparen\u021bei, \u00eentr-o manier\u0103 care s\u0103 permit\u0103 reprezentan\u021bilor publici, lobby-stilor, mediului de afaceri, cet\u0103\u021benilor s\u0103 ob\u021bin\u0103 informa\u021bii \u00een leg\u0103tur\u0103 cu activit\u0103\u021bile de lobby<sup>2<\/sup>.  Proiectul de ordonan\u021b\u0103 prevede \u00eenfiin\u021barea Registrului de lobby \u0219i de reprezentare a intereselor (&#8222;Registru&#8221;), f\u0103r\u0103 a intra \u00een detalii cu privire la modalitatea de func\u021bionare a acestuia \u0219i cu privire la accesul la acesta.  In acest sens, articolul 8 aliniatul (2) din Proiectul de ordonan\u021b\u0103 prevede accesul persoanelor fizice \u0219i juridice la datele din Registru numai <em><strong><u>\u00een condi\u021biile justific\u0103rii unui interes juridic prioritar<\/u><\/strong><\/em> \u00een sensul articolului 8 aliniatul (2) din Conven\u021bia European\u0103 a Drepturilor Omului<sup>3<\/sup>.  Dup\u0103 cum se poate lesne observa din lecturarea acestui articol din Proiectul de Ordonanta, accesul persoanelor fizice \u0219i juridice este \u00eengradit f\u0103r\u0103 s\u0103 existe o justificare clar\u0103 \u0219i f\u0103r\u0103 a se men\u021biona \u00een concret modalitatea de acces a acestor persoane la datele din Registru.<br \/>\nO alt\u0103 modalitate de asigurare a transparen\u021bei este ca orice act legislativ s\u0103 con\u021bin\u0103 identificarea precis\u0103 a lobby-stului\/ lobby-stului intern\/ asocia\u021bie de interese\/ reprezentant al grupurilor de interese.  De asemenea, este indicat ca \u0219i emiten\u021bii politicilor publice s\u0103 indice lobby-stului\/ lobby-stului intern\/ asocia\u021bie de interese\/ reprezentant al grupurilor de interese care a \u00eencercat s\u0103 influen\u021beze un anumit aspect legislativ<sup>4<\/sup>.<br \/>\nAr fi necesar ca legisla\u021bia secundar\u0103 cu privire la activit\u0103\u021bile de lobby s\u0103 trateze aceste aspecte.<\/li>\n<li> \tCrearea \u0219i implementarea unor standarde privind activitatea de lobby, al\u0103turi de monitorizarea \u00eendeplinirii acestor standarde.<br \/>\nPornind de la scopul legifer\u0103rii activit\u0103\u021bii de lobby, consider\u0103m util\u0103 redactarea \u0219i implementarea standardelor, principiilor, procedurilor care s\u0103 statuteze modalit\u0103\u021bile prin intermediul c\u0103rora reprezentan\u021bii publici pot interac\u021biona cu lobby-i\u0219tii \u0219i\/sau lobby-i\u0219tii interni \u0219i\/sau asocia\u021biile de interese, \u00een scopul promov\u0103rii intereselor legitime.  Desi Proiectul de ordonan\u021b\u0103 men\u021bioneaz\u0103 generic interdic\u021biile \u0219i o conduit\u0103 ce trebuie urmat\u0103 de c\u0103tre reprezentan\u021bii publici \u00een conformitate cu prevederile Legii 161\/2003 privind unele m\u0103suri pentru asigurarea transparen\u021bei \u00een exercitarea demnit\u0103\u021bilor publice, a func\u021biilor publice \u0219i \u00een mediul de afaceri, consider\u0103m necesar\u0103 o reglementare viitoare cu privire la maniera de comunicare \u0219i interac\u021biune a reprezentan\u021bilor publici cu societ\u0103\u021bile de lobby \u0219i\/ sau societ\u0103\u021bile care angajeaz\u0103 lobby-sti interni.<\/li>\n<\/ul>\n<h2>Concluzii<\/h2>\n<p>Reglementarea activit\u0103\u021bii de lobby este binevenit\u0103 \u00een Rom\u00e2nia dar acest lucru trebuie facut intr-un mod judicios si corelat cu celelalte aspecte relevante pentru activitatea de lobby.  De\u0219i Proiectul de Ordonan\u021b\u0103 este destul de lacunar astfel cum am men\u021bionat mai sus, opinia noastra este ca reglementarea acestei activit\u0103\u021bi trebuie s\u0103 reflecte fidel principiile OECD de transparen\u021b\u0103 \u0219i integritate \u00een lobby.
