National Antibribery Conference, 2nd edition

On 28 March 2016 Neil McGregor, as our Managing Partner and as Vice-Chairman of the British-Romanian Chamber of Commerce, gave a presentation to the conference of the Romanian National Institute of Internal Control on the recent enforcements of the UK’s Bribery Act 2010 in respect of failing to prevent foreign bribery. By contrast with the emphasis of Romanian legislation on punishing people who are caught in acts of corruption, the British approach is to place a duty on companies to prevent bribery. Neil explained the statutory defence to charges of failing to prevent bribery, by demonstrating that adequate procedures had been put in place to create an effective anti-bribery culture. Unfortunately not all companies take these compliance measures seriously enough and Neil also explained how some companies had made mistakes in their compliance procedures, and how substantial penalties had been imposed on them as a result.
